You Have the Right to a Safe Workplace in New York and New Jersey

  • Inform employees of the location and availability of their medical and exposure records and provide access to these records if requested.

  • Post OSHA citations at or near violation areas. Citations must remain posted until the violation is corrected, or for 3 working days, whichever is longer.

  • Display the official OSHA poster that describes rights and responsibilities under the Act in a prominent place.

 

Employees also have the right to:

  • Access to review standards, rules, regulations, and OSHA requirements.

  • Access relevant employee medical and exposure records, including work related injuries and illnesses.

  • Request an OSHA inspection by the area director if they believe hazardous conditions or violations exist in the workplace.

  • Have an employee chosen representative accompany the OSHA inspector during the inspection.

  • Have their names withheld from their employer, upon request to OSHA, if they sign and file a written complaint.

  • Be free from any discrimination or retaliatory action from their employer as a result of an OSHA complaint.
