Is the New York Distracted Driving Law Effective?

It sure is, and last month the texting and driving law got even tougher. In July 2011, Governor Cuomo signed a new distracted driving bill into law in New York. A court settlement required that the Federal Motor Carrier Safety Administration (FMCSA) issue new Hours of Service rules by July 26, 2011. Accordingly, at the end of December the agency issued its new proposed Hours of Service regulations, which were open for comment until March 2011.

The FMCSA suggested that the Hours of Service rules be amended to reduce fatigue-related truck accidents by:

Requiring that a driver's work day end after 14 hours in most cases.
Limiting the maximum driving hours in one shift to 10 -11 hours.
Requiring that drivers have at least 30 minutes off for every 7 hours of driving.
Only restarting the weekly duty period once a week and if the driver was provided two periods off between midnight and 6 a.m.

National Cancer Institute Issues Results of Important New Lung Cancer Study

The early stages of lung cancer are usually silent. There are no symptoms, and the person does not know about the terrible disease lurking undetected in his or her chest. At the same time, that person's best chance of survival is early detection. So, how can that be accomplished? How can lung cancer be detected if it is asymptomatic?

Last month, the National Cancer Institute released the results of a study that may help answer those questions. According to the results of the study, using annual low-dose CT-scans to screen for lung cancer in heavy smokers (and former heavy smokers) may decrease lung cancer deaths by 20% when compared to the use of annual chest x-rays to screen for lung cancer.*

If the cancer is caught early, even before symptoms appear, then tumors may be removed surgically before the cancer spreads throughout the body, and this may greatly increase a patient's chances of survival.

The National Lung Screening Trial studied 53,000 current and former smokers who had smoked an average of one pack a day for at least 30 years and were between the ages of 55 and 74. It is unclear what recommendations will come out of this study and whether one pack a day for 30 years and over age 55 will become a new standard in using low dose CT-Scans to screen for this dangerous disease.

Seeking a Cure for Cerebral Palsy

Did Medical Malpractice Kill a New York City Baby?

A Brooklyn hospital is investigating the recent death of a 6-month-old baby. According to the New York City medical examiner's office, 6-month-old Amaan Ahmmad was given an adult dose of the antibiotic azithromycin while he was at Brookdale University Hospital being treated for pneumonia last month.
The hospital discharge summary indicates that Amaan was given 500mg of azithromycin "in error." His parents report that the adult dose was approximately six times the dose that their child should've received.

The child was allegedly brought to Brookdale University Hospital on Friday October 21, 2011 because he was running a fever. A cousin of the child's has told the media that the baby was put on antibiotics via IV. The boy allegedly suffered cardiac arrest, was declared brain dead, went into a coma and died on Tuesday October 25, 2011. The media reports that nursing notes reflect that it took at least 36 minutes for hospital staff to respond to Amaan's symptoms on the day of his death.
The hospital has told the media that it is investigating the circumstances of Amaan's death.

Head on Collision Takes a Life in Queens

A 37-year-old is dead and several other people are injured after a wrong-way crash in Queens last month. The crash occurred around 6:30 a.m. on Saturday, October 15 on the service road to the Long Island Expressway.

Accident reports indicate that a Chrysler Sebring was travelling the wrong way on the service road and crashed head-on into a livery cab. The driver of the Sebring reportedly left the scene of the accident on foot.

The 37-year-old victim was a passenger in the livery cab. The victim and the driver of the livery cab were taken to Elmhurst General Hospital. The victim was declared dead on arrival and the driver's condition was unknown. A passenger from the Sebring was also taken to Elmhurt General Hospital and reported to be in stable condition. The identities of the drivers and passengers have not yet been released to the media.

The service road in Maspeth was shut down as police investigated this fatal New York City accident.

Recently, President Obama declared the bridge eligible for fast track funding. Various hearings are being held in the area to determine the best design for a new bridge. Some favor a lower cost bridge that may not include designated lanes for express buses and tracks for commuter rails. Others view the low cost option as short cited and believe that the updated bridge should be built to accommodate mass transit and improve safety. A third option is to build the bridge without the commuter rail but leave room for that to be added in the future.

If an existing plan for a new Tappan Zee Bridge is approved and passed, experts anticipate that it could be viable for about 100 years and it could be ready as early as 2017. Four People Injured in Bronx Car Accident

Two cars collided in the East Tremont section of the Bronx last month, leaving four people injured. This New York City car crash occurred shortly before 5 p.m. on Tuesday, October 11, 2011 near the intersection of Marmion Avenue and East 175th Street.

According to accident witnesses, one of the cars went through a stop sign and crashed into the other car. One of the cars then hit a nearby building.

No pedestrians or people inside the building were reported to be injured. However, three people in one of the cars and one person in the other car were injured and were transported to the hospital. Reports of the accident indicate that three people had to be cut out of one of the vehicles and they were all taken to Saint Barnabas Hospital.

Witnesses report that one of the injured women was bleeding from the mouth and a child had a leg stuck in the backseat of the car. None of the four people who were hurt are believed to have sustained life threatening injuries in this Bronx car accident.

Food Deliveryman Killed in Brooklyn Car Accident

According to the New York City Police Department (NYPD) a scooter driver was killed in a Brooklyn car accident on Monday October 10, 2011.The 41-year-old scooter driver was working as a Chinese food deliveryman when he was hit by a 2002 Buick around 7 p.m. on Leonard Street in the Williamsburg section of Brooklyn.

Reports of this fatal Brooklyn crash indicate that the driver of the scooter stopped his vehicle at the stop sign located at the intersection of Leonard Street and Meserole Avenue. However, it is alleged that the 29-year-old driver of the Buick did not stop and instead crashed into the back of the scooter.

The scooter operator, who has not yet been identified to the media pending notification of his family, was taken to Bellevue Hospital where he died from his accident injuries.

The driver of the Buick as not injured in this crash but was taken into custody by the NYPD for driving while intoxicated. Charges were pending against the driver as of Monday, October 10.

West Milford New Jersey Student Hospitalized After Being Hit by School Bus

On Friday morning, September 23, 2011, a West Milford student was hit by a school bus. According to reports of the accident, the student who was hit is a 15-year-old boy in his sophomore year at West Milford High School. The boy has been identified as Jason Maxwell.

The accident occurred around 7:20 a.m. on Macopin Road near Westbrook Road. Fog may have complicated the boy's recovery. Authorities have said that the fog was too heavy to safely land a medical helicopter and an ambulance dispatched to the accident scene was involved in a crash of its own on the way to help the boy. Nobody was hurt in the ambulance accident and a second ambulance was sent to get the West Milford High School student to the hospital.

The student was taken to Morristown Memorial Hospital and was reported in stable condition after the crash. The driver of the bus was taken to Chilton Memorial Hospital with chest pains. None of the 30 students on board the bus were reported injured.

New Jersey Woman Killed By Distracted Driver

A 28-year-old Hoboken waitress was struck by an Amcare van and killed on Saturday, September 17, 2011. According to police, the waitress, Irina Alekseeva, was crossing 14th Street in Hoboken, New Jersey around 5:40 a.m. in order to get back to her job at the Malibu Diner.

As Ms. Alekseeva was crossing 14th Street, an Amcare van hit her. Police allege that the 29-year-old driver of the van was distracted at the time of the accident. Specifically, it is alleged that the driver was reaching for a clipboard to record information about an 89-year-old passenger whom he had just picked up.

Witnesses report that the driver seemed to lose control of the van and hit Ms. Alekseeva before driving onto the sidewalk and hitting a light pole and parked cab.

Ms. Alekseeva suffered a severe laceration to her leg and her head. Additionally, she suffered a significant break in her leg. Her injuries are said to have caused her death within an hour of this New Jersey accident.

The van driver and his passenger were both taken to Jersey City Medical Center. There is no report on their condition.

Queens Bus Takes the Life of New York Construction Worker

44-year-old Cesar Cepedes was working on a lift under an overpass at Sutphin Boulevard and Archer Avenue in the Jamaica area of Queens on Monday, September 19, 2011. At approximately 11:40 p.m. the top of an MTA bus hit Mr. Cepedes's lift and caused him to fall to the ground. The bus had been heading north on Sutphin Boulevard and hit the lift on which Mr. Cepedes was working while traveling through the Long Island Rail Road overpass.

Mr. Cepedes allegedly suffered severe head trauma in this New York City accident . He was taken to Jamaica Hospital Medical Center where he was pronounced dead.

The New York City Police Department (NYPD) and the Occupational Safety and Health Administration (OSHA) are investigating the accident. The NYPD reports that the bus driver remained at the scene of the accident and is not currently facing any charges. He was tested for alcohol and drugs, as is customary after any type of accident. Results of those tests typically take a few days and were not immediately available.

Man Killed in Grand Central Parkway Hit and Run

A recent hit and run accident on the Grand Central Parkway has cost a 65-year-old man his life. This fatal New York City crash occurred in the early morning hours of Thursday, September 15, 2011.

According to accident investigators, Mr. Jerry Kishun rear-ended another vehicle around 4:30 a.m. near the 82nd Street exit. That accident appeared to be minor. However, when Mr. Kishun got out of the car, presumably to assess the damage and talk to the other driver, he was hit by another vehicle.

The police have told the media that they found Mr. Kishun unresponsive on the road and had him transported to Elmhurst Hospital where he is said to have died from his accident related injuries.

News reports indicate that the police would like to talk to both the driver who was rear-ended in this crash and the driver who allegedly hit Mr. Kishun, as neither driver was at the scene when the police arrived.

Young New Jersey Man Dies From Car Accident Injuries

On March 17, 2011 William Ryan Steidl was hit by a car while jogging in Denville, New Jersey. The 23-year-old Randolph resident suffered significant head injuries in the New Jersey accident, but had made some progress in the months since the crash. Then, at 11 a.m. on Thursday September 15, 2011 Mr. Steidl died from his accident injuries - almost six months to the day after the car accident occurred.

Mr. Steidl's father reports that Mr. Steidl was taken to Meadowlands Hospital on Wednesday September 14, 2011 when it appeared that his head was swollen. He was transferred from Meadowlands Hospital to Overlook Medical Center where he died the next day.

The driver who hit William Ryan Steidl had already been charged with careless driving. It is unclear whether the driver will now face additional charges because of Mr. Steidl's death.

Mr. Steidl is remembered as a wonderful person who was always helping others. He is survived by both of his parents, his younger brother Evan, his grandfather August, and many friends and relatives. City College Student Killed in Brooklyn Crash

On the morning of September 1, 2011, 21-year-old City College student Karam Rampersaud was riding his motorcycle on Loring Avenue when a Ford Taurus turned in front of him and the bike and car collided. Mr. Rampersaud was allegedly caught underneath the car and dragged for about 30 feet before the driver of the Taurus stopped.

Witnesses report that Mr. Rampersaud was badly hurt by the time the Taurus stopped. The driver of the Taurus was issued a summons for failure to yield.

Rescue workers from the New York City Fire Department (FDNY) and New York City Police Department (NYPD) came to the scene of the accident. Together, the emergency workers began to lift the car off of Mr. Rampersaud.

There is some discrepancy about what happened next. Some witnesses report that the car was accidently dropped on Mr. Rampersaud as the NYPD and FDNY workers were lifting the car. The NYPD and FDNY deny that claim.

While it remains unclear whether the accident injuries or the rescue were the cause of Mr. Rampersaud's death, what is clear is that there is a family grieving the loss of loved one. New York City Drunk Driving: Leandra's Law One Year Later

In 2009, 11-year-old Leandra Rosado was killed by a drunk driver in a one-car crash on the West Side Highway. In 2010, Leandra's Law went into effect and required people convicted of drunk driving in New York City to have an ignition interlock device installed in their car for a minimum of six months or to surrender their licenses.

Now it is 2011 and it has been just about a year since Leandra's Law went into effect. In the first year of the law, 2,562 drivers were convicted of drunk driving. However, only 528 installed ignition interlocks in their vehicles.

Why the Discrepancy?

According to city and state officials, people get around installing the devices by transferring the title of their vehicles to friends or relatives. Then, when they are asked about the ignition interlocks they tell officials that they no longer own vehicles in which they could install such devices.

Failing to install an ignition interlock device, if required, is a criminal misdemeanor that is punishable by up to one year in jail.

State officials remind people that the rate may be low because convicted drunk drivers simply choose to take mass transit in New York City rather than install the devices.

Man Dragged by Car Across Brooklyn Bridge After Rear-End Accident

According to New York City Police, a man was dragged along the Brooklyn Bridge by a car and suffered significant injuries last month. The accident occurred in the early morning hours of Sunday August 20, 2011 near Cadman Plaza on the top of the Brooklyn Bridge. Authorities believe that the man was dragged for about 300 yards before he fell off the car and suffered head injuries.

Reports of the accident indicate that 26-year-old Arturo Gomez was driving a Chevrolet Suburban on the Brooklyn bound side of the bridge around 12:45 a.m. when he was rear ended by a black sedan. It is reported that the driver of the sedan initially stopped at the New York City accident scene, but tried to flee the scene when Mr. Gomez got out of his car, started assessing damage and taking pictures of the accident damage. Mr. Gomez, noticing that the driver was trying to leave the scene of the accident, grabbed on to the car, and was dragged across the Brooklyn Bridge.

Mr. Gomez was taken to Bellevue Hospital and was reported to be in stable condition following this New York car accident.

Woman Dies in Scary New York I-95 Truck Accident

A 62-year-old woman was killed and her 84-year-old mother was injured in a truck accident on I-95 in Westchester County last month. The accident occurred on Tuesday, August 16 when, according to New York State Police, two tires flew off a tractor-trailer truck and crashed into the car driven by Adele Mancuso of Toms River, New Jersey. The crash occurred as the truck was exiting I-95 for I-287 in Port Chester.

Investigators believe that the tractor-trailer may have lost its entire rear axle, with the wheels attached, and that the axle was in the air for approximately 100 yards - going over approximately 3 lanes of southbound traffic - before it crashed onto the roof and windshield of the car driven by Ms. Mancuso in the northbound lane of the interstate. Ms. Mancuso was killed at the accident scene.

Ms. Macuso's mother, Constance Casalina of Larchmont, was treated for minor injuries related to the accident at Stamford Hospital.

The truck driver left the scene of the accident and was located later in the day in New Jersey where he was questioned by police.

10-Year-Old Tourist Killed in Queens Crash

A 10-year-old Australian girl was killed in a New York City car accident on what was believed to be her last day in the United States before returning home. Sabrina Mangos was a passenger in a minivan that was traveling in Astoria, Queens on the evening of Saturday, August 6. At the intersection of 34th Avenue and 31st Street, the minivan collided with a Nissan Sentra.

The minivan flipped on its side after the collision. Seven people, including four adults and three children, were in the minivan. Emergency responders had to remove the injured people from the wreckage of the vehicle. Witnesses report that when the van was put in an upright position, Sabrina was on the street.

She was brought to Mount Sinai Hospital of Queens where she died.

The other six passengers were all taken by ambulance to Mount Sinai or to Elmhurst Hospital Center and all are expected to survive. The driver of the Nissan Sentra, a 55-year-old male, was walking and alert at the accident scene.

The cause of this New York City car accident remains under investigation.

Motorcyclist Killed in Manhattan Crash

At approximately 4:30 a.m. on Saturday August 6, 2011 a motorcyclist was stopped at a traffic light at the intersection of 46th Street and 12th Avenue in Manhattan. When the light turned green, the motorcyclist was rear-ended by a Honda. The biker has been identified as 22-year-old Kastrioit Prelaj of New Rochelle, New York.

The force of the impact caused the Mr. Prelaj to be thrown from his bike and into the intersection. As Mr. Prelaj lay on the road another vehicle hit him. The driver of the vehicle who hit him was arrested on New York drunk driving charges. The driver of the Honda who caused the initial accident fled the scene of the crash.

Mr. Prelaj was reportedly unresponsive when police and emergency workers arrived at the scene. He was taken to Roosevelt Hospital where he was later pronounced dead from his accident injuries.

New York City Police are continuing their investigation and asking businesses with surveillance video and any accident witnesses to please come forward and assist the investigation of this deadly New York City accident.

13-Year-Old Hero Saves the Lives of Brooklyn Children

The night of Saturday July 31, 2011 started like any other summer evening for 13-year-old Kira Goddard and her friends. The kids were hanging out outside of their Brooklyn building, located at 2025 Pacific Street in Brownsville, talking and playing games like they usually did. However, this night did not end like all of the summer nights the friends had enjoyed together. This night ended with Kira's death.

Sometime around 10 p.m. Kira noticed a car sideswipe three parked vehicles and starting yelling at her friends and her younger sister to run. All of the other kids got back inside their building, but Kira did not. Kira was allegedly pinned between her home and a Range Rover driven by 44-year-old Sean Lewis. Kira was declared dead at the scene of the accident.

Mr. Lewis was taken to Brookdale University Hospital and Medical Center where he died following this Brooklyn car accident. He allegedly had a stab wound in his torso and head wounds from the accident.

Queens Car Accident Kills Rosedale Teen

A 19-year-old passenger of a Dodge Charger was killed in a Queens car accident on Friday July 22, 2011. The crash occurred on 225th Street at N. Conduit Ave. in Springfield Gardens.

According to reports of this fatal New York City accident, 24-year-old Luis Forero was driving a Mitsubishi Montero and tried to pass a Dodge Charger late that Friday night. Mr. Forero did not successfully pass the Montero, however, and crashed into the vehicle. According to police, the impact of the collision sent the Montero into a fence and caused it to flip over and land on its roof before skidding approximately 150 feet.

19-year-old Brian Hemmings of Rosedale was riding in the backseat of the Montero. He was pinned under the vehicle and had to be extricated by the New York Police Department. He was killed in the crash.

Three other people were in the Montero and reportedly escaped this New York City crash with only minor injuries.

Mr. Forero left the scene of the crash but turned himself in to police shortly after the accident.

Frightening Fall From FDR Drive

Atif Raza has only been driving a New York City cab part-time for three months but even the most experienced cabbies could not have expected the type of accident that Mr. Raza was lucky enough to live through on Saturday, July 16.

Mr. Raza was stopped a red light when an SUV flew off of FDR Drive and fell approximately 20 feet onto his cab, which was flattened. The force of the impact caused the car to drag the cab about 150 feet on the service road near East 23rd Street feet before stopping.

Amazingly, nobody was killed at the scene of the accident. A total of eight people were involved in this New York crash, including Mr. Raza and 7 people in the SUV. All eight people were taken to Bellevue Hospital and at least two people were listed in critical condition.

According to reports of the accident, the SUV was driven by 38-year-old Eric Bryant of New York City. Mr. Bryant passed a breathalyzer test and the cause of this crash remains under investigation. Mr. Bryant allegedly lost an ear in this crash and one of his passenger's legs had to be amputated.

Fifteen-Year-Old Boy Dies in Queens Crash

On Thursday July 14, fifteen-year-old Awsaf Islam was riding his scooter in Sunnyside. The next day, he died from injuries he sustained when a motorcycle and a livery cab crashed into him on July 14.
According to reports of the accident, Christian Mora was attempting to turn his motorcycle off of 48th Avenue and on to 45th Street when he hit the bumper of a livery cab, spun out and hit Awsaf. The livery cab was driven by Wessppim Depena, who had L.A. Lakers forward Lamar Odom as a passenger in the backseat. Mr. Odom was reportedly being taken to a barber shop in his old neighborhood while he was in New York for a cousin's funeral.

Mr. Odom and Mr. Depena were not reported injured in this crash. However, Mr. Mora and Awsaf were immediately taken to Elmhurst Hospital Center with serious injuries. Awsaf died the following day from massive head injuries.

Awsaf's mother was able to see him before he died. His father lives in the family's native country of Bangladesh. Awsaf's family decided to donate the child's organs after his death.

Brooklyn Crash Kills 32-Year-Old Woman and Injures Two Others

32-year-old Nyron Isaac was arrested after a Brooklyn car accident that killed one of his passengers and injured another. The crash occurred around 5:52 a.m. on Saturday, June 25, 2011. Mr. Isaac was traveling north on Fourth Avenue in Sunset Park when he hit a traffic signal between 25th and 26th Streets. He then also collided with the median and a parked car. Accident witnesses report that Mr. Isaac was walking in circles and saying that he didn't know who was driving at the time of the fatal accident.

32-year-old Keisha Nelson was in the backseat of the vehicle and was killed in the crash. A 21-year-old female who was also a backseat passenger was injured. The female, who is reported to be Mr. Isaac's cousin, was taken to Lutheran Medical Center and was reported to be in serious but stable condition the day following the accident. Mr. Isaac also suffered significant injuries in this car wreck.

Police have arrested Mr. Isaac and charged him with manslaughter, vehicular manslaughter, aggravated unlicensed operation of a vehicle and driving while intoxicated.

New York City Bike Crash Kills 68-Year-Old Marilyn Dershowitz

Marilyn Dershowitz, mother, wife, retired Manhattan Supreme Court special referee and sister-in-law of attorney Alan Dershowitz, was killed in a New York City bike accident on Saturday July 2, 2011. On that afternoon, Mrs. Dershowitz and her husband, Nathan Dershowitz, were out for a bike ride on West 29th Street near Ninth Avenue in Chelsea when Mrs. Dershowitz was hit by a United States Postal Service truck. The driver of the truck left the scene of the accident because he allegedly did not know that he hit anyone. He was found a short time later. Police do not expect to charge the mail truck driver in relation to this New York City crash and fatality.

Mrs. Dershowitz was rushed to Bellevue Hospital where she died later that afternoon. She was laid to rest on July 5, 2011. Marilyn Dershowitz was 68 years old. She retired from her job a few months ago and, according to her husband, looked forward to enjoying life and spending time with her grandchildren.

Mrs. Dershowitz is survived by her husband, her two children, her three grandchildren and her extended family. We extend our sincere condolences to her husband, children, grandchildren, relatives and friends following this tragic accident.

One Car Hits Two Pedestrians at Meadowlands Stadium

A 23-year-old driver is accused of hitting two pedestrians in the parking lot of the New Meadowlands Stadium after a sold out soccer match on Saturday night June 18, 2011.

New Jersey state police report that Angel Gonzalez was driving in parking lot J-11 shortly before 11:30 p.m. that evening when he hit one pedestrian with the front left of his vehicle. Then, Mr. Gonzalez reportedly put his car in reverse and hit 40-year-old Ricardo Lazaro and a parked vehicle with no passengers inside.

Mr. Lazaro was taken to Hackensack University Medical Center with serious injuries. He was reported to be in critical condition in the days following this New Jersey car crash. The first pedestrian did not report the accident and remains unidentified.

Mr. Gonzalez is accused of fleeing the scene of the crash and was stopped by state troopers on the southbound New Jersey Turnpike.

Authorities say that the results of Mr. Gonzalez's toxicology reports will take about 8 weeks to come back. He has already been charged with assault by auto and leaving the scene of an accident with serious bodily injuries. He was being held at Bergen County jail on $30,000 bail.

Nine People Injured in Six-Car New Jersey Accident

Nine people were sent to the hospital after a six-car crash in Brick Township on Saturday June 11, 2011. The crash occurred at the intersection of Route 70 and Van Zile Road shortly after 6:30 p.m.

According to police, John Pflug of Lakewood was driving west on Route 70 when he suffered a medical emergency. His wife was in the passenger's seat and tried to gain control of the vehicle, but was unable to do so before the car struck the median divider and rear-ended a Nissan Sentra.

After hitting the Sentra, the Pflugs' car allegedly continued to accelerate and hit a Mercury Marquis and a Nissan Maxima before spinning in reverse and hitting a Ford Explorer and one other vehicle.

Mr. and Mrs. Pflug were taken to Jersey Shore University Medical Center with serious injuries, as were Nancy Hoffman and Rosalie Honan who were in the Nissan Sentra. Everyone else involved in the crash was taken to Ocean Medical Center in Brick with non-life threatening injuries.

The investigation began with a road closure lasting about five hours and is ongoing.

Second Serious Crash for Bus Company Approaching Lincoln Tunnel

A serious crash claimed the life of a motorcyclist near the New Jersey entrance to the Lincoln Tunnel shortly after noon on Saturday June 11, 2011. The victim's name has not yet been released, but he has been identified as a white male in his mid 50s from Pennsylvania. The motorcyclist was declared dead at the scene of this Weehawken, New Jersey crash.

While the cause of the accident is still under investigation, media reports indicate that the motorcyclist was stopped at the toll plaza when he was hit by a bus labeled Carl R. Bieber Tour. Carl R. Bieber Tour is a bus company based in Pennsylvania. In May 2011, a Carl R. Bieber Tour bus collided with an SUV near the same entrance to the Lincoln Tunnel. Five people were injured in that New Jersey bus crash.

No other injuries were reported in this New Jersey motor vehicle accident. Inbound Traffic toward Manhattan was backed up for more than six hours before the fatal accident scene was eventually cleared around 7 p.m.

New York City Intersection Accident Kills Pedestrian

A New York City car accident took the life of an 89-year-old woman on Thursday June 2, 2011. The crash occurred just after noon at the corner of West 145th Street and Seventh Avenue. According to reports of the accident, a Lincoln Town Car livery cab was attempting to turn left onto 145th Street when it was hit by a Toyota pickup truck that was traveling south on Seventh Avenue.

The force of the crash allegedly sent the pickup truck onto the sidewalk and into a group of pedestrians. Leonia White was among the group of pedestrians. She was taken to Harlem Hospital where she was pronounced dead. Three other pedestrians and the driver of the Lincoln Town Car livery cab were taken to St. Luke's Hospital with what are believed to be non-life threatening injuries.

Witnesses to the crash report that this intersection may be particularly dangerous for pedestrians. Officials are still investigating the cause of this New York pedestrian fatality.

Significant Rise in New Jersey Highway Fatalities Reported for Early 2011

The New Jersey State Police released important information just before Memorial Day Weekend. According to Police, New Jersey highway accident fatalities are up significantly when compared to the first part of 2010.

Before the long holiday weekend, 230 people had died on New Jersey highways during 2011. 195 people died in New Jersey highway accidents during the same period of 2010. That is almost an 18% increase in fatalities.

Officials have not yet indicated why there has been a significant increase in highway deaths, though they have told the media that an early analysis reveals that distracted driving may be one factor contributing to the increase in fatalities.

The New Jersey State Police announced this information at the same time that they announced their 100 Days of Summer Campaign, which will focus on seatbelt use and sober driving during the traditionally dangerous driving season that occurs during the months between Memorial Day and Labor Day.

Fatal Brooklyn Crash May Result in a New NY Safety Law

On May 12, 2011 4-year-old Moses Englender was riding his tricycle on Heyward Street in Brooklyn when he was hit by a delivery truck and killed. According to police, the truck driver did not see the little boy prior to the deadly crash because Moses was so small and low to the ground and the truck driver was high in the cab of his vehicle.

This tragic Brooklyn accident has renewed calls by politicians, including Mayor Bloomberg, for laws that would require trucks to be equipped with a device known as a crossover mirror. A crossover mirror, which is currently required for school buses, allows a truck driver to see the pavement in front of him and, hopefully, to avoid accidents such as the one that took the life of Moses Englender.

Each crossover mirror costs approximately $100. Proposals to require crossover mirrors on New York trucks have failed in the past. However, there is hope that images from the scene of the May 12 fatal crash will allow Brooklyn legislators such as State Senator Martin Golden and Assemblywoman Joan Millman to get a new law passed in New York that may prevent future New York accidents.

Three Car New Jersey Crash Injures Four and Kills One

The three-car crash on New Road in South Brunswick, New Jersey was fatal on Sunday May 15, 2011. According to reports of the early afternoon crash, 51-year-old Richard Russell was driving a 2010 Hyundai Electra eastbound when he entered the westbound lanes to pass slower vehicles in front of him. When Mr. Russell pulled back into the eastbound lane he allegedly rear-ended a 2004 Mitsubishi driven by 25-year-old Amy Paulmann, who had her 3- and 4-year-old children with her in the car. Ms. Paulmann's vehicle struck a fire hydrant, utility pole and tree as she was forced off of the road.
After hitting Ms. Paulmann's vehicle, Mr. Russell allegedly ended up back in the westbound lane where he collided with a 1994 Toyota driven by 33-year =old Firozanden Mansuri.

Ms. Mansuri was critically injured in the crash and taken to Robert Wood Johnson University Hospital in New Brunswick. Ms. Paulmann and her two children were all taken to St. Peter's University Hospital in New Brunswick. Mr. Russell was declared dead at the scene of the accident.

New York City Elevator Crash Injures 22

Shortly after 7 a.m. on Wednesday May 18, 2011, New York City rescue workers were called to a building in the Flatiron District of Manhattan. Specifically, the call came to respond to 620 6th Avenue, between 18th and 19th Streets, after a freight elevator in the building which was going up suddenly stopped between the 3rd and 4th floors and started to fall. The elevator fell 3 - 4 stories until it reached the basement.

22 people were injured in this early morning New York City accident. All are said to have suffered whiplash-like injuries. Nine of the injured had to be taken to area hospitals on stretchers. The remaining 13 people were taken to Bellevue Hospital for observation. The names of the injured have not yet been released.

The cause of this New York City elevator accident remains under investigation. Early reports indicate that the elevator's last inspection was in May 2010 and no deficiencies were found. Additionally, nobody reported anything unusual about the operation of the elevator prior to this accident.

A complaint has already been filed with the City about this accident and the City is investigating.

New York City Pedestrian Dies After Being Hit by Alleged Drunk Bus Driver

An L&L Travel tour bus was returning from New York City to Newark on Saturday night May 7, 2011 when a tragic accident occurred. According to reports of the accident, 29-year-old Timothy White was crossing 9th Avenue when he was hit by the bus as it was turning onto 9th Avenue from 47th Street.

It is alleged that the driver of the bus, 57-year-old Steve Drappel, was drunk at the time of the crash. According to law enforcement officials, Mr. Drappel failed two breath tests and vodka was found in his possession while the accident was being investigated. He faces drunk driving and vehicular manslaughter charges.

At this time, it is believed that Mr. White got hit by the back of the bus and was caught under its rear wheels as the bus driver continued to operate the vehicle. The driver was alerted to the problem by another pedestrian. Mr. White was taken to Bellevue Hospital Center where he was pronounced dead.

There were no reports of injury to the driver or to the 40 passengers on board the bus at the time of the fatal accident.

Young Bicyclist Dies in Brooklyn Crash

On Thursday May 5, 2011, 22-year-old Luis Torres was killed in a car-bicycle crash on the streets of Brooklyn. Mr. Torres was delivering pizzas for Amnon Kosher Pizza at about 6:30 that evening when he was hit by a Budget box truck.

According to accident witnesses, the truck driver fled the scene of the accident at Fort Hamilton Parkway and 59th Street. Police were able to find him several blocks away and expected to charge the driver with various violations. The truck driver's identity has not yet been released but he is described as a 25-year-old male.

Mr. Torres was taken to Lutheran Hospital where he was pronounced dead. Mr. Torres and his family moved to the United States 2 years ago from Ecuador. He is survived by his 19-year-old wife, Laura Campoberdecq, his two-year-old daughter Kelly Denisse Inga, and other family members and friends.

New Law Impacts Recovery of New York Infants Who Suffer Neurological Birth Injury

Last month, a new fund was created in New York. The fund is designed to pay the medical expenses for infants who suffer neurological damage due to medical malpractice at birth. The law, Public Health Law §2999-h[1], defines "birth-related neurological injuries" as "an injury to the brain or spinal cord of a live infant caused by the deprivation of oxygen or mechanical injury occurring in the course of labor, delivery or resuscitation or by other medical services provided or not provided during delivery admission that rendered the infant with a permanent and substantial motor impairment or with a developmental disability."

Participation in the fund will be mandatory for families seeking Medicaid or who file medical malpractice lawsuits. Families would still have the right to file medical malpractice lawsuits for non-medical costs associated with neurological birth injuries including out-of-pocket expenses and emotional damages.

Opinions on the new fund are divided. Proponents of the fund believe that the establishment of the fund will provide fair compensation to injured infants in a way that the courts cannot because many courts have trouble predicting an injured infant's future medical needs. Opponents of the fund argue that infants will not be able to get the best medical care under the new law and that instead they will be limited to nursing care that is available at the Medicaid rate.

The details of the fund should become clearer in coming weeks as state regulations are drafted and lawsuits are filed.

One-Car Bronx Accident Kills One and Injures Six

A serious Bronx car crash took the life of a 61-year-old woman and injured several others on Thursday April 21, 2011. The accident occurred when a livery cab crashed into the Cee & Cee Department Store at 331 East Fordham Road in the Bronx.

The accident occurred shortly after 3 p.m. when the cab was headed through the Bainbridge Avenue and East Fordham Road intersection. According to reports of the crash, the cab lost control and hit the department store storefront. The exact cause of the accident remains under investigation.

The woman who died has been identified as Carmen Ahmed. Ms. Ahmed, who was shopping at Cee & Cee Department Store, was allegedly pinned under the vehicle until she was rescued and taken to St. Barnabas Hospital where she was pronounced dead.

The driver of the vehicle, two passengers in the vehicle and three people inside the store were also injured. They were all taken to St. Barnabas Hospital and reported to be in stable condition. Their names have not yet been released to the media.

Armor Was Needed Outside Armory When SUV Jumped Curb in Brooklyn

Four people were injured when an SUV drove onto the sidewalk near the Park Slope Armory at the corner of Eighth Avenue and Fifteen Street in Brooklyn on April 15, 2011 at about 4:15 p.m.

According to people who witnessed the accident, an SUV driven by a man in his mid 60s hit a car, ended up on the sidewalk and kept going. The SUV hit four women before becoming wedged between a tree and a light pole. There were many children nearby the accident because the YMCA recreation center was open in the armory at the time of the wreck. Thankfully, none of the children were injured in this Brooklyn car crash.

Two of the women who were injured were taken to New York Methodist Hospital and two of the women were taken to Lutheran Medical Center. None of the injuries are believed to be life threatening.

According to police, it is possible that the driver fell asleep or suffered a condition that caused him to lose consciousness just prior to the accident. The accident investigation is ongoing.

Déjà vu? Another Queensboro Bridge Crash Claims a Life

Recently, we wrote about a fatal accident on the Queensboro Bridge. Now, we are sad to report that another serious crash has occurred with eerie similarities. Specifically, both accidents involved a Volkswagen, they occurred at the same intersection, and they happened at the same time of day.

In the second crash, which occurred on April 6, 2011, the driver was speeding and unlicensed. A 40-year-old woman, Beatriz Rodriguez, was riding in the front seat. She was taken from the accident scene and listed in critical condition with head trauma. She died the next day from her accident injuries.
The driver of the car, Mr. Alexander Palacio, was reported to be in stable condition.

In response to these crashes, the Transportation Department has said that it will add signs reminding people not to exceed to the 30 miles per hour speed limit. The Transportation Department also plans to install rumble strips as a reminder to passengers who are about to leave the roadway.

Some area shop owners remain concerned over the traffic patterns and alleged dangers for motorists and for those who work in their stores.

New York Family Devastated by Alleged DWI Crash

An alleged drunk driving accident took the life of a 30-year-old mother and critically injured a 21-year-old man on Saturday April 7, 2011. The one-car crash occurred around 5 a.m. on the Belt Parkway near Flatbush Avenue at Marine Park.

Officials say that 34-year-old Kareem DuPass was driving a Ford Explorer when he hit a guardrail and the SUV flipped over. His girlfriend, the mother of one of his children, 30-year-old Amanda Marty, was in the front seat and his brother, 21-year-old Jason DuPass, was in the backseat.

Amanda and Jason were taken to Brookdale University Hospital. Amanda died at the hospital and Jason was in a coma on the night of the accident.

Kareem DuPass has had several charges filed against him including manslaughter, criminally negligent homicide, DWI, reckless driving and speeding.

Ms. Marty is survived by her boyfriend, Kareem DuPass, his 16-year-old son and the couple's 12-year-old son.

Police Charge Driver with Drunk Driving Following Fatal New Jersey Crash

On April 2, 2011 a three-vehicle accident killed one person and injured two others on the Garden State Parkway. The crash occurred around 11 p.m. near mile marker 120 in Aberdeen.

New Jersey State Police report that a Chevrolet Cobalt hit the back of a Ford Freestar in the local lanes of the Parkway. The impact of that collision allegedly caused the Freestar to overturn, go over a guard rail and land in the express lane where it was hit by a Toyota Sienna.

The driver of the Freestar has been identified as 43-year-old Kevin Donnelly. Mr. Donnelly was pronounced dead at the scene of the crash. One of his passengers, 42-year-old Erin Small, was taken to Robert Wood Johnson University in serious condition. She suffered internal injuries. The other passenger, 48-year-old Kenneth Mackenzie, was taken to Jersey Shore Medical Center with back and neck injuries.

The driver of the Chevrolet Cobalt has been charged with drunk driving. He was not injured, and the investigation into this New Jersey fatal accident is continuing.

Veteran Taxi Driver Killed in New York Pedestrian Crash

A camera inside the beauty salon at Crescent Street and Queens Plaza South recorded part of a fatal, and by all accounts gruesome, crash on March 29, 2011.

The accident occurred when a red 2007 Volkswagen was exiting the Queensboro Bridge on the Queens side. The car allegedly failed to negotiate the curve, lost control, become airborne, and flipped over, hitting a pedestrian and a building.

The pedestrian who was hit has been identified as 68-year-old Anthony Buscemi, a New York City taxi driver who had just left the subway and was walking to work on the sidewalk outside the Villa de Beaute Salon at about 4 a.m. on March 29.

Mr. Buscemi, a 25-year veteran cab driver, was killed at the scene of the accident. He is survived by a son.

Witnesses of the accident say that the whole front end of the car was taken off. The car driver, whose name has not yet been released, was taken to the hospital in critical condition. His passenger was taken to the hospital in stable condition.

Traffic was disrupted throughout the morning commute as officials investigated and cleaned up the crash.

Conflicting Causes Reported for March 12 Bronx Bus Accident

Even though it has been weeks since the March 12 bus accident that killed 15 people and injured 19 people in the Bronx, the investigation into what caused the accident continues. The New York bus crash occurred on I-95 at about 5:30 a.m. as a bus was returning to New York City's Chinatown from a Connecticut casino.

As New York State Police and federal officials continue to investigate the cause of this accident, the driver and passengers are starting to speak out. The bus driver asserts that he was sober and well rested at the time of the crash. He explains the accident by alleging that he swerved to avoid crashing into a tractor-trailer.

Passengers on the bus allege that the driver was drowsy and that he swerved onto the shoulder of the road several times before the fatal accident. One of the passengers has accused the driver of "negligently falling asleep" at the wheel.

Staten Island Crash Kills One, Injures More Than a Dozen

A serious accident took the life of one man and injured 14 more on Wednesday, March 9, 2011. The accident occurred shortly after noon at the Richmond Road/Burgher Avenue intersection in Staten Island.

There were two vehicles involved in this crash. One was a fire truck from Ladder 81 responding to a call, and the other was a van operated by Lifestyles for the Disabled. The fire truck went through the red light with its sirens on and allegedly sideswiped the van that was making a left on a green light.

The crash caused the van to hit a retaining wall. One person was ejected from the van and one was trapped inside the van. He was rescued by the firefighters.

There were nine people aboard the van. One person, a 51-year-old man with developmental disabilities, was killed. The other eight people are reported to be in stable condition. Six firefighters suffered minor injuries in the crash, and all are expected to recover.

The man who lost his life is reported to have participated in the Special Olympics. His name has not yet been released. Dozens Injured in Lincoln Tunnel Accident

An early morning crash in the Lincoln Tunnel resulted in serious injuries on Thursday morning February 24, 2011. The accident involved a motorcycle and 3 buses at approximately 7:25 a.m., during the height of the morning rush hour. The center tube of the Manhattan-bound tunnel was closed for hours as emergency officials helped the injured and police investigated the cause of the crash. Traffic delays continued throughout the morning.

Early reports from the accident scene indicated that the motorcyclist was taken to Bellevue Hospital in critical condition. He was allegedly pinned under one of the buses during the crash. Approximately 60 people aboard the bus also suffered injuries, which are believed to be non life threatening.

Approximately 13 people were taken to Roosevelt Hospital in New York with serious injuries.

Both New York and New Jersey officials responded to the accident. The New York Fire Department reports that the motorcyclist was riding between the two buses when the front bus stopped for traffic and the rear bus crashed into the motorcyclist and the front bus.

Williamsburg Bridge Accident Kills 1 and Injures Another

A three-vehicle accident took the life of a 27-year-old driver and injured a 32-year-old driver on Monday February 21, 2011. The crash occurred on the Williamsburg Bridge at approximately 11:15 p.m.

The 27-year-old victim was driving a Honda Civic that stalled near the Brooklyn - Queens Expressway split on the Brooklyn-bound side of the span. The victim got out of his car and was standing in front of it when a taxi cab hit the car from behind and the Civic hit the driver. The driver was allegedly killed by the impact of the crash and was pronounced dead at the scene of the accident.

After the cab hit the Civic, the cab was rear ended by a Ford Econoline van. The cab driver was injured and taken to Bellevue Hospital with what are believed to be non life threatening injuries. The driver of the van was not reported to be injured in the crash.

Police do not intend to charge either driver in this accident.

New Jersey Nursing Home Employee Charged With Assault and Abuse

Earlier this month, 59 year old Julia C. Galvan was arrested for allegedly assaulting and abusing an 87 year old nursing home resident. Ms. Galvan was an employee at Harborage, a 245 bed nursing home facility located on River Road in North Bergen, New Jersey where she allegedly assaulted her victim. The victim, whose name has not yet been released to the media, died two days after the alleged January 2011 assault.

According to reports, the assault was captured on camera and Ms. Galvan struck the female victim three or four times to the head. The police report that the victim's daughter had put the surveillance camera in her mother's room because she was concerned about how her mother was being treated. The daughter contacted police on February 23, 2011 after viewing the assault on the videotape.
Ms. Galvan has not been charged with murder because the victim was receiving hospice care and police do not believe the attack was the reason for her death.

Harborage has received Medicare ratings of 5 out of 5 stars for health inspections, 2 out of 5 stars for quality measure and 1 out of 5 starts for staffing. Harborage has told the media that it takes the allegations against Ms. Galvan very seriously and that she has been terminated.

New Law Passed Regarding New York City Bicycle Statistics

Last month, Mayor Bloomberg signed important legislation that will require New York City to collect bicycle accident data. Currently, the City is not required to collect information regarding New York City bicycle accidents. However, the new law will require the City to compile statistics regarding bicycle accidents with motor vehicles, pedestrians, and other bicyclists and to keep track of the injuries and fatalities that result from those crashes.

Part of the reason for the legislation stemmed from an April 2009 bicycle accident that killed a 50 year old husband and father of 12 year old twins. On April 28, 2009 Stuart Gruskin was walking on West 43rd Street in Manhattan. Before he crossed the street, he looked in the direction of the motor vehicle traffic and saw nothing coming. He entered the road and was hit by a bicycle delivery person who was driving the wrong way down the one way street. Mr. Gruskin fell and hit his head. He suffered a significant brain injury and was taken to Weill Cornell Medical Center. He died three days later.

His wife, relatives, and friends have worked hard to increase pedestrian and bicyclist safety and this legislation is important to that cause and to the safety of New York City pedestrians and bicyclists.

New York City Traffic Accident Fatality Rate Increases After Historic Low

2009 was a record-breaking year in New York City. It was the year of the lowest recorded number of traffic deaths in the City since records began being kept about 100 years ago. That record was not broken in 2010.

In 2010, traffic deaths began creeping back up in the five boroughs. 269 people lost their lives in fatal New York City accidents last year. That represents a five percent increase in traffic deaths over 2009. The number of fatalities among motorcyclists in New York City increased more dramatically. The 2010 New York City motorcycle fatality rate was 34 percent higher than it was in 2009. Similarly, the number of bicyclists who lost their lives in New York City accidents rose in 2010. Eighteen bicyclists were killed in 2010 compared with 12 bicyclists in 2009.

Overall, New York City has one of the lowest traffic fatality rates in the United States. However, to the families of the 269 people who lost their lives, that brings little comfort, and to the many others who were injured, the relatively low traffic fatality rate does not relieve pain and suffering.

NYC Cab Jumps Curb, Hits Pedestrian and Crashes Into Bank

The situation was dangerous for those near the intersection of Broadway and 69th Street in the early evening hours of Saturday February 5, 2011. At around 7 p.m. that night a taxicab jumped the curb, hit a pedestrian and crashed into the Capitol One Bank at Broadway and 69th.

Before hitting the bank, the cab took out a traffic light, a one-way sign and a 32-year-old-woman. A 46-year-old woman was a passenger in the back of the cab.

It is currently unclear what caused the cab driver to lose control and jump the curb. The driver told reporters that he was rear ended by another vehicle as he drove north on Broadway, though the cause of the accident remains under investigation by authorities.

When witnesses to this New York City cab crash got to the pedestrian she was face-down on the sidewalk, but she was able to speak. Both the pedestrian and the passenger in the cab were taken to the hospital with injuries. The cab driver was not reported to be injured.

New York City's Most Dangerous Intersections

A recent study found that some of New York City's busiest and most congested intersections are also the city's most dangerous intersections. The study released by the Tri-State Transportation Campaign found that the most dangerous street in the City is Broadway, where 18 people died during the survey period. Eleven of the Broadway fatalities occurred in Manhattan and the remaining seven occurred in the Bronx.

Other dangerous roads in New York City included Seventh Avenue, West Side Highway, Kings Highway, Ocean Parkway in Brooklyn, Atlantic Avenue in Brooklyn, and the Grand Concourse in the Bronx. Queens Boulevard, which is often considered one of New York City's most dangerous streets, was not included on the list of the City's most dangerous roads, though it saw at least five fatalities during the survey period.

Many of the fatalities that occurred on these roads were New York City pedestrian accidents. The reasons for the fatalities included both negligent drivers and distracted pedestrians. The study's authors are encouraging New York City pedestrians not to text and walk and not to listen to music too loudly while walking because the results can be catastrophic.

Alleged Drunk Driver Kills One and Injures Two in Paterson

Late last month, an alleged drunk driving accident took the life of one person and injured two others in Paterson, New Jersey. According to Paterson police, a 23-year-old Paterson resident named Roger Gallego will be facing vehicular homicide charges for the death of 22-year-old Tiffany Robinson, also of Paterson. Other charges, including drunk driving charges, may be possible.

The accident occurred around 3:15 a.m. on Sunday January 30, 2011, when Mr. Gallego allegedly ran a stop sign and hit a car with a driver and two passengers. Ms. Robinson was in the front seat of the vehicle that was hit and was reportedly ejected through a window and pronounced dead at the scene of the accident. The driver and a back seat passenger in the vehicle were taken to St. Joseph's Regional Medical Center in Paterson for treatment. They were later released from the hospital. There is no report of any injury to Mr. Gallego.

Mr. Gallego was held on $100,000 bail in Passaic County jail following this New Jersey car accident.

Car Flips on Staten Island Expressway, Injuries Reported

A serious Staten Island car accident injured at least one person and tied up traffic for hours on the afternoon of February 3, 2011. The crash occurred when a car driven by a 63-year-old man flipped over on the Brooklyn-bound Staten Island Expressway near the Clove Road exit, shortly before 12:30 p.m. Pictures from the accident scene reveal that the car landed on the side of the road and very close to the guardrail.

According to reports, the driver lost control of his car after another vehicle rear ended him, though the official cause of the crash has not yet been reported.

Numerous emergency vehicles and officials responded to this Staten Island accident and traffic on the Verrazano Narrows Bridge was severely impacted.

The 63-year-old driver was the only one reported to be injured in this crash at this time. His identity has not yet been released. Reports indicate that he was in serious condition with significant but not life threatening injuries.
