Since its inception at the end of 1970, the Occupational Safety and Health Administration (OSHA) has had the difficult task of creating regulations to protect workers without making those regulations so burdensome that they unduly interfere with employers' ability to operate their businesses.

In addition to creating regulations, OSHA must enforce the regulations in order for the safety requirements to actually protect workers. As part of its enforcement OSHA not only identifies the most common violations but also imposes penalties against employers who commit the violations.

The violations that result in the greatest penalties are not always the most common violations committed. In Fiscal Year 2010, 5 of the top 10 violations that resulted in the highest penalties were violations committed in the construction industry.

It is remarkable that, out of all of the industries in the United States, half of the violations that resulted in the highest penalties were in one single industry. As a New York construction worker, however, you are likely not surprised by the five construction related violations that made the list, including*:
  • Number 1 - Fall protection
  • Number 2 - Electrical
  • Number 3 - Safety Training and Education
  • Number 7 - Excavations
  • Number 10 - Ladders

If you have been injured in a construction accident in New York or New Jersey, you may be entitled to compensation for your injuries. Please call an experienced New York accident attorney today at 1-800-PAGAN-911 for more information.
